The Occupational Safety and Health Administration (OSHA) enforces workplace safety and health laws. OSHA enforces its laws through Compliance Officers who inspect workplaces for safety violations. Compliance visits are initiated through a variety of mechanisms including:
- Imminent danger situations
- Severe injuries and illnesses
- Worker Complaints of hazards or violations also receive a high priority
- Referrals of hazards from other federal, state or local agencies, individuals, or organizations
- Targeted inspections
- Follow-up inspections
Following an OSHA Enforcement action, employers may be cited and fined if they do not meet compliance standards. Employers have the option of contesting fines and penalties and can also negotiate a settlement with OSHA to reduce the penalties and citations. Our team will work with Attorneys following an enforcement action and/or citation to help mitigate the game or assist in defense of a client. We also help develop corrective action plans to meet OSHA standards.
